You can download
a 60-day evaluation copy of the Champ Class Library free of charge and try
it out under our Shareware User License
Agreement. Once you purchase a registered copy of Champ, your use is
governed by the following
Registered User License Agreement and Limited
Warranty
(1) Introduction. This agreement explains when and how you may
use registered copies of software products from Salvisberg Software &
Consulting. In this agreement:
- "Library" means the Champ Class Library software product
you have purchased from us or from a dealer, including source code
header files, linkable .LIB and .DLL files, software tools, associated
documentation in electronic and/or printed form, and other materials;
- "we", "us", "our" refers to Salvisberg
Software & Consulting, a company based in Spiegel b. Bern,
Switzerland; and
- "you" means the end user(s) of the Library.
(2) Legal Agreement. This is a legal agreement which allows you,
the end user, to use the Library under certain terms and conditions. IMPORTANT:
If you don't agree with this Agreement, you must return the Library to us
or to the dealer where you purchased it for a refund.
(3) Copyright. The Library is fully protected by copyright under
national law and international treaty provisions. It is and remains our
valuable intellectual property.
(4) License Types. There are a number of different license
types, which give you certain rights. The fourth letter in your license
keycode determines your type of license:
- CP-P:
- The Personal License is for individual use of the
Library on you own computer(s). You may use it just like a book, which
means it may be used by any number of people and it may be moved from
one computer location to another, as long as there is no possibility of
it being used in more than one location or by more than one person at
the same time. Programs that you create using the Library may be used,
given away or sold without additional license or fees. Your name and a
reference to the Library is embedded in every program.
- CP-E:
- The Educational License is for use by educational
institutions. It covers all members of the institution in their
positions (faculty, staff, students). You may install the Library on all
computers and/or the network of your institution for unlimited use by
all members. You are responsible for informing all users of the Library
in the institution about the terms of this license agreement. Programs
that you create using the Library may be used or given away without
additional license or fees, but they may not be sold. The name of the
institution and a reference to the Library is embedded in every program.
The Educational License includes Home Licenses for all members of the
institution.
- CP-H:
- The Home License allows current members of an
institution with an Educational License to use the library on their
private computer at home. Programs that you create using the Library are
strictly for your own use and will not run on computers that don't have
the E or H license installed. However, you may recompile the programs at
the institution, putting them under the Educational License.
- CP-F:
- The ProFessional License is for individuals and
companies developing applications with the Library. Every developer
needs his/her own license. Programs that you create using the Library
may be used, given away or sold without additional license or fees, and
they do not include any reference to you or to the library.
- CP-T:
- The Temporary License replaces one of the other
license types until the keycode for the permanent license is delivered
to you. The provisions for the permanent license apply accordingly.
(5) Prohibited Use of the Library. You may not permit other
individuals to use the Library except under the terms listed here. You may
not modify, translate, reverse engineer, decompile, disassemble, or create
derivative works that substantially duplicate the functionality of the
Library, without our advance written permission. You may not change,
remove, or disable any proprietary notices in the Library. All rights not
specifically granted in this Agreement are reserved.
(6) Making and Distributing Copies of the Library. You may make
copies of the Library software as necessary for use according to your
license type and for normal backup purposes. You may print out the
documentation and distribute it to the users covered by your license, with
the exception of Home users. You agree not to make any other copies of the
software, the documentation or other materials, or any part of them, or
sell, give, or make available any copies to others, without our advance
written permission.
(7) Distributing Programs Created with the Library. Your license
type determins if and under what conditions you may distribute the
programs you created with the Library. You shall remain solely responsible
for, and will hold us harmless from, all claims, liability and damages
arising from your own products which include any of the Library's
routines.
(8) Operation of the Library. The Library offers powerful
capabilities. If you do not follow our instructions, or if you use the
Library improperly, you can destroy files or cause other damage to your
software and data. You assume full responsibility for the selection and
use of the Library to achieve your intended results.
(9) LIMITED WARRANTY:
Physical Defects. We pledge that the disks and manuals we send
you (if any) will arrive free of physical defects which interfere with
normal use. If you find such a defect and report it to us within 90 days
after you purchase the Library, we agree to replace the defective item(s)
at no charge to you as long as the defect was not caused by misuse or
abuse.
Bugs and Program Errors. We don't promise that the Library
will be free of bugs or program errors. If you report a program error or
bug to us, we will use our best efforts to correct it. If we issue a
maintenance release for the Library which includes a correction for an
error you reported, we will send you a copy of that maintenance release at
no charge if you request it. We will only do this for maintenance
releases, not for new major releases or other new versions of the Library.
Satisfaction Guarantee. If you are dissatisfied with any
product you buy from us under this Agreement for any reason, you may
return it at any time up to 90 days after purchase and we will give you a
refund. Refunds will be based on the price you paid, less shipping costs.
You must contact us before returning any product for a refund. This
satisfaction guarantee does not apply to Educational Licenses or to
purchases of more than 10 individual copies at one time.
(10) DISCLAIMERS AND LIMITATIONS. And now the legal language we
couldn't avoid:
EXCEPT FOR THE LIMITED WARRANTY STATED ABOVE, WE DISCLAIM ANY AND ALL
OTHER WARRANTIES, EXPRESS OR IMPLIED, ORAL OR WRITTEN, INCLUDING ANY
IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
This limited warranty gives you specific legal rights, but you may have
other rights, depending on where you purchased the Library.
LIMITATION OF LIABILITY. IN NO EVENT SHALL WE BE LIABLE FOR ANY
INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES WHATSOEVER ARISING OUT OF
USE OF THE LIBRARY OR OF PROGRAMS CREATED WITH IT, OR YOUR RELATIONSHIP
WITH US, EVEN IF WE SHALL HAVE BEEN INFORMED OF THE POSSIBILITIES OF SUCH
DAMAGES. Some countries or states do not allow exclusion or limitation of
liability for incidental or consequential damages, therefore the above
limitation may not apply to you.
(11) GOVERNING LAW. THIS LICENSE AGREEMENT AND LIMITED WARRANTY
SHALL BE CONSTRUED, INTERPRETED AND GOVERNED BY THE LAWS OF THE COUNTRY OF
SWITZERLAND AND YOU AGREE TO BRING ANY ACTION HERUNDER ONLY IN THE COURTS
OF BERNE, SWITZERLAND.
